These Terms and Conditions govern the use of this website, the purchase of products, and the booking or use of services provided by Higher Consciousness Energy.

By accessing or using this website, purchasing a product, or booking a service, you agree to these Terms and Conditions.

These terms apply to all visitors, customers and clients. Services may include Quantum Healing Hypnosis Technique (QHHT), Reiki, Cosmoenergy sessions, pendulum guidance and coaching, card readings and healings, visualisations, meditations, Yin Yoga, therapeutic massage, private spiritual retreats and related holistic modalities.

Additional terms, descriptions or conditions shown on an individual product, service, event or booking page also form part of the agreement.

Higher Consciousness Energy reserves the right to determine whether a service is suitable for a minor and to request parental or guardian involvement where appropriate.

That leaves you free to work with teenagers if you choose, without promising every service is suitable for every child.

Services and products are generally intended for persons aged 18 or older.

A person under the age of 18 may use the website or receive a service only with the permission and, where appropriate, involvement of a parent or legal guardian.

Certain services may be unsuitable for minors or may require additional consent. Any age-related conditions shown on the relevant service page will apply.

5. Intellectual Property

Unless otherwise stated, the text, images, videos, recordings, meditations, visualisations, graphics, branding, logos, course material and other original content on this website belong to Higher Consciousness Energy or are used with permission.

Such content may not be copied, reproduced, republished, sold, modified, distributed or used commercially without prior written permission.

Purchasing a product or service does not transfer ownership of any intellectual-property rights.

Content may be viewed or downloaded solely for personal, non-commercial use where that functionality is provided.

6. Products

Higher Consciousness Energy may offer physical products including books, jewellery, clothing, yoga-related products, spiritual lifestyle products, handcrafted items and one-of-a-kind pieces.

Reasonable efforts are made to present product descriptions, measurements, materials, colours, images, prices and availability accurately.

However:

colours may vary slightly between screens;
measurements may contain small variations;
handcrafted, vintage, natural or upcycled items may contain individual variations;
one-of-a-kind items may not be replaceable with an identical product.

Variations that form part of the disclosed handmade, artistic, vintage or natural character of a product are not automatically considered defects. This does not affect statutory rights where a product is faulty, damaged or materially different from its description.

Product availability may change. An order may be cancelled and refunded if a product is unavailable because of an inventory error or another unavoidable circumstance.

7. Prices and Payment

Prices are displayed in the currency shown on the website.

Any applicable taxes will be included or identified as required by law. Delivery charges and any other applicable costs will be shown before the customer completes the order.

Customers outside the European Union may be responsible for import duties, customs charges, taxes or handling fees imposed by the destination country, unless otherwise stated.

Payment is due at the time of purchase or booking unless a different arrangement is expressly agreed.

Orders and bookings are subject to successful payment authorisation.

Higher Consciousness Energy may correct an obvious pricing or technical error. Where an order has already been placed at an incorrect price, the customer will be informed and offered the choice of confirming the order at the correct price or receiving a refund.

8. Orders and Formation of the Agreement

Submitting an order or booking request does not necessarily mean that it has been accepted.

An agreement is formed when the customer receives confirmation that the order or booking has been accepted, subject to payment and availability.

The customer is responsible for checking that the order, contact information, delivery address, selected service, date and time are correct before completing the purchase.

Higher Consciousness Energy may refuse or cancel an order or booking where reasonably necessary, including in cases of:

suspected fraud;
incorrect pricing;
product unavailability;
safety concerns;
abusive or inappropriate behaviour;
circumstances that make delivery or performance impossible.

Where payment has already been received and the order or booking is cancelled by Higher Consciousness Energy, the relevant amount will be refunded.

9. Delivery

Processing, shipping, tracking, customs and estimated delivery information are set out in the separate Shipping & Delivery Policy.

Delivery times are estimates unless a specific guaranteed delivery date has been expressly agreed.

Higher Consciousness Energy is not responsible for delays caused by customs, carriers, severe weather, industrial action, incorrect address details or other circumstances outside reasonable control. This does not limit any mandatory consumer rights.

The customer is responsible for providing a complete and accurate delivery address.

10. Returns, Refunds and Withdrawal

Returns and refunds for products are governed by the separate Returns & Refunds Policy.

Consumers purchasing eligible products or services online will generally have a 14-day legal right of withdrawal, subject to statutory exceptions. For goods, the period usually begins when the customer receives the goods. For service contracts, it generally begins when the contract is concluded.

The right of withdrawal may not apply, or may end early, in circumstances permitted by law, including certain personalised goods, unsealed hygiene products, fully performed services, date-specific leisure activities and digital content supplied with the customer’s prior consent and acknowledgement.

A withdrawal request may be submitted through the Cancel an Online Purchase page or through another clear written statement.

Nothing in these Terms and Conditions restricts statutory rights relating to faulty, damaged or misdescribed goods.

11. Service Bookings

The nature, duration, location, price and any special requirements for a service will be described on the relevant service or booking page.

The client is responsible for:

providing accurate information relevant to the session;
arriving or joining at the agreed time;
informing Higher Consciousness Energy of relevant practical concerns;
deciding whether the service is appropriate for their circumstances;
seeking qualified medical or psychological advice where necessary.

No specific result or outcome is guaranteed.

Where a service is provided remotely, the client is responsible for having suitable internet access, equipment and a safe, private environment.

12. Starting a Service During the Withdrawal Period

Where a consumer books a service online and requests that the service begin during the statutory withdrawal period, express consent may be required before the service begins.

If the consumer subsequently withdraws after performance has started, a proportionate amount may be payable for the part of the service already provided, where permitted by law.

Where a service has been fully performed during the withdrawal period with the consumer’s prior express consent and acknowledgement, the right of withdrawal may be lost where the law permits this.

13. Client Cancellations and Rescheduling

Unless different cancellation or rescheduling terms are specified for a particular service, retreat, workshop, event or booking, at least 24 hours' notice is requested for the cancellation or rescheduling of an individual session.

Where less than 24 hours' notice is given, or a client fails to attend a scheduled session without prior notice, a cancellation charge of up to 100% of the session fee may apply, where reasonable and permitted by applicable law.

Retreats, workshops, special events and other services with their own booking conditions are subject to the cancellation, payment and refund terms provided for those specific bookings.

Nothing in this section limits any statutory consumer rights, including any applicable legal right of withdrawal.

Cancellation or rescheduling requests may be submitted by email, telephone or through the website contact form.

14. Cancellation by Higher Consciousness Energy

A session, event or retreat may occasionally need to be cancelled or rescheduled due to illness, safety concerns, travel disruption, insufficient attendance or other circumstances beyond reasonable control.

Where Higher Consciousness Energy cancels a paid service and no suitable alternative is agreed, the amount paid for the cancelled service will be refunded.

Unless required by law, Higher Consciousness Energy is not responsible for unrelated costs such as transport, accommodation or loss of income. Clients are encouraged to use flexible bookings or appropriate travel insurance for retreats and events.

15. Retreats, Events and Date-Specific Activities

Retreats, workshops, classes and other services scheduled for a specific date may be subject to separate booking, cancellation, deposit and participation conditions.

The statutory right of withdrawal may not apply to certain leisure services where the agreement provides for a specific date or period, where the applicable legal exception applies.

Any separate conditions will be presented before booking and will form part of the agreement.

16. Health, Healing and Wellbeing

Higher Consciousness Energy offers complementary and holistic services intended to support physical health and wellbeing, mental and emotional wellbeing, energetic balance, release of limiting patterns, negative beliefs and accumulated tension.

The services are intended to support letting go, inner liberation and a return to neutrality, peace, clarity and presence.

Depending on the service and the individual, sessions may support physical comfort, emotional release, mental quiet, energetic balance and a deeper experience of being present without the interference of limiting or negative beliefs.

Each person’s experience is individual and no specific outcome can be guaranteed.

Higher Consciousness Energy does not provide medical diagnoses or prescribe medication. These services may complement medical, psychological or other professional care where such care is needed.

Clients remain responsible for their own healthcare decisions. Any changes to prescribed medication or medical treatment should be discussed with the relevant qualified healthcare professional.

In a medical or mental-health emergency, the appropriate emergency services should be contacted.

17. QHHT and Hypnosis Disclaimer

Quantum Healing Hypnosis Technique and related hypnosis or guided-imagery services are intended as introspective and self-inquiry experiences.

Memories, impressions, imagery or information experienced during hypnosis may be subjective, symbolic, imaginative or otherwise open to interpretation. They should not automatically be treated as independently verified facts.

QHHT and hypnosis do not replace psychotherapy, psychiatric treatment, medical treatment or other professional care.

Participation is voluntary, and the client remains responsible for personal decisions made following a session.

18. Reiki, Cosmoenergy, Readings and Spiritual Guidance

Reiki, Cosmoenergy, pendulum guidance, card readings, spiritual guidance, energy-based practices and similar services are offered for personal reflection, relaxation, spiritual exploration and wellbeing.

No claim is made that these services can predict the future with certainty, diagnose illness, cure disease or guarantee a particular outcome.

Information shared during such services should not be used as the sole basis for medical, legal, financial or other significant life decisions.

19. Massage, Yoga and Physical Participation

Before participating in massage, yoga, movement or other physically involved services, the client must disclose any relevant injury, pregnancy, medical condition, physical limitation or other concern that may affect safe participation.

The client is responsible for listening to their body, working within personal limits and stopping if pain, dizziness, discomfort or another concerning symptom occurs.

Higher Consciousness Energy may decline, modify or stop a session where this is reasonably considered necessary for safety.

These services do not replace assessment or treatment by a doctor, physiotherapist or other qualified healthcare professional.

20.Retreats, Workshops and Date-Specific Events

Private retreats, workshops, classes and other scheduled events may be subject to additional booking terms, deposits, preparation requirements and cancellation conditions specific to that event.

Any retreat- or event-specific terms will be provided before booking and form part of the agreement between Higher Consciousness Energy and the participant.

Due to the nature of retreats and events, including limited availability, advance planning and costs incurred in preparation, cancellation terms may differ from those applicable to individual services.

Where applicable, refunds, transfers or credits will be determined in accordance with the retreat or event-specific booking conditions and applicable consumer law.

Participants are responsible for ensuring they are physically and mentally able to participate in the activities included in the retreat. Any relevant medical conditions, allergies, injuries or accessibility requirements should be communicated before the retreat begins.

Higher Consciousness Energy reserves the right to modify the programme, schedule, location, facilitators or activities where reasonably necessary due to weather conditions, safety considerations, unforeseen circumstances or events beyond reasonable control. Such changes will not automatically entitle participants to a refund.

Participants are responsible for arranging appropriate travel, insurance, visas and any other personal requirements unless expressly stated otherwise.

21. Personal Responsibility and Conduct

Clients participate voluntarily and remain responsible for their own choices, conduct, wellbeing and decisions.

Respectful behaviour is required during sessions, events, retreats and communications.

Higher Consciousness Energy may end or refuse a service where a person behaves in an abusive, threatening, discriminatory, sexually inappropriate, unsafe or seriously disruptive manner.

Where a service is ended for such reasons, any refund will depend on the circumstances and applicable law.

22. Confidentiality

Personal information shared during private sessions will be treated confidentially, subject to the Privacy Policy and applicable law.

Confidentiality may be limited where disclosure is required by law or is reasonably necessary to respond to an immediate and serious safety concern.

No session may be recorded by either party without prior agreement, except where recording is a clearly disclosed part of the service and appropriate consent has been obtained.

23. Privacy and Personal Data

Personal data is processed in accordance with the separate Privacy Policy and applicable data-protection law.

The Privacy Policy explains the purposes and legal bases for processing, retention, sharing, international transfers where applicable, and the rights available to individuals.

Consent is not the only possible legal basis for processing personal data. Data may also be processed where necessary to fulfil a contract, comply with a legal obligation or pursue a legitimate interest, as described in the Privacy Policy.

24. Testimonials and Results

Testimonials reflect individual experiences and are provided for general information only.

Experiences and outcomes differ from person to person. No testimonial, statement or description guarantees that another customer or client will achieve the same result.

Subject to that limitation, Higher Consciousness Energy is not responsible for indirect or consequential loss that was not reasonably foreseeable when the agreement was made.

Higher Consciousness Energy is not responsible for loss caused by:

inaccurate information supplied by the customer or client;
failure to follow reasonable instructions;
misuse of products or services;
circumstances outside reasonable control;
reliance on holistic or spiritual information as a substitute for professional advice.

Any limitation of liability applies only to the maximum extent permitted by applicable law.

29. Force Majeure

Higher Consciousness Energy will not be responsible for delay or failure caused by circumstances outside reasonable control, including severe weather, natural disasters, illness, transport disruption, governmental action, war, civil unrest, telecommunications failure, epidemic, pandemic, utility failure or interruption of third-party services.

Where performance is substantially affected, reasonable efforts will be made to communicate with the customer and provide an appropriate solution.

30. Complaints

order or booking number, where applicable;
a clear description of the issue;
the preferred resolution.

Reasonable efforts will be made to acknowledge and respond to the complaint within an appropriate period.

This section does not limit the right to seek assistance from a competent consumer-protection authority or court.

31. Changes to These Terms

These Terms and Conditions may be updated where necessary because of changes to the website, products, services, business practices or applicable law.

The revised version will be published on this page with an updated revision date.

Changes will not normally apply retrospectively to orders or bookings already concluded unless required by law or expressly agreed.

Continued browsing alone will not remove rights already acquired under an existing contract.

32. Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply.

These Terms and Conditions are governed by the laws of the Netherlands.

Where the customer is a consumer living in another country, this choice of law does not remove any mandatory consumer protection available under the law that would otherwise apply.

Disputes may be submitted to a competent Dutch court, unless mandatory law gives the consumer the right to bring proceedings in another competent jurisdiction.

Nothing in this section prevents the parties from first attempting to resolve a dispute informally or through an appropriate mediation or dispute-resolution procedure.
